These Terms & Conditions (“Terms”) govern your access to and use of services provided by Spectrum Phoenix LLC, doing business as Spectrum Submeter (“Company,” “we,” “us,” or “our”). By accessing our website, customer portals, or using our services, you agree to these Terms.

1. Services

Spectrum Submeter provides utility submetering, billing, and related account services to property owners, managers, and tenants. Services may vary by property, jurisdiction, and contractual arrangements.

2. Role as Billing Service Provider

Spectrum Submeter acts as a utility billing service provider on behalf of property owners and managers. Utility charges are calculated based on meter data, utility rates, and applicable regulatory requirements.

3. Rates, Fees, and Billing Compliance

We strive to comply with all applicable federal, state, and local laws governing utility billing.

  • Utility Rates: Utility charges billed to tenants will not exceed the applicable residential rate or rate structure permitted by the local utility or governing authority, as required by applicable law.
  • Administrative and Service Fees: Administrative or service-related fees, if applicable, are disclosed on tenant billing statements or lease documentation and assessed only where permitted by law.
  • Late Fees: Late payment charges, if applicable, are governed by the tenant’s lease agreement and applicable state laws requiring such fees to be reasonable and lawful.

4. Digital and Electronic Communications

By accessing our portal or providing contact information, you consent to receive electronic communications related to your account, including billing statements, notices, and service alerts.

Text Message Communications: If you provide your mobile phone number, you consent to receive SMS or MMS messages from Spectrum Phoenix LLC (d/b/a Spectrum Submeter) related solely to billing, payment reminders, account alerts, and service notifications.

  • Supported carriers include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, Cricket, Virgin Mobile, and others
  • Carriers are not liable for delayed or undelivered messages

Spectrum Phoenix LLC does not charge for text message alerts.

5. Billing Disputes and Resolution

If you have a billing concern or dispute, please contact us at [email protected]. We will make reasonable efforts to investigate and resolve billing issues promptly. Nothing in these Terms limits your right to seek assistance from applicable state or local regulatory agencies.

6. State-Specific Tenant Protections

Certain states provide additional protections related to utility billing, dispute resolution, and payment arrangements. These protections apply where required by applicable law and are not waived by these Terms.

7. New York Residents – HEFPA Notice

Rates will not exceed those charged by the local distribution utility. Billing disputes may be directed first to Spectrum Submeter and then to the New York Public Service Commission (PSC) at 1-800-342-3377. Additional protections may apply for elderly, disabled, or medically vulnerable tenants.

8. User Responsibilities

You agree to provide accurate and current account information, maintain the confidentiality of your account credentials, and notify us promptly of changes to contact or billing information.

9. Limitation of Liability

To the fullest extent permitted by law, Spectrum Phoenix LLC shall not be liable for indirect, incidental, or consequential damages arising from the use of our services or communications.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, except where superseded by mandatory state utility or consumer protection laws.

11. Changes to These Terms

We may update these Terms periodically. Continued use of our services constitutes acceptance of the updated Terms.
